Welcome to Rola Notary, a service operated by Rola LLC ("Rola Notary," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website located at www.rolanotary.com, our online booking platform, and all Mobile Notary, Remote Online Notarization ("RON"), Loan Signing, and related services we provide.

By accessing our website, requesting a quote, scheduling an appointment, purchasing a service, or otherwise using our services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, Cancellation & Refund Policy, Accessibility Statement, and any other policies referenced on our website.

If you do not agree with these Terms, you should not use our website or schedule services.

These Terms constitute a legally binding agreement between you and Rola Notary.

1. Definitions

For purposes of these Terms, the following definitions apply:

"Company"

"Company," "Rola Notary," "we," "our," and "us" refer to Rola LLC, doing business as Rola Notary, including its owners, employees, contractors, commissioned Florida Notaries Public, Certified Notary Signing Agents, Remote Online Notaries, agents, and authorized representatives.

"Customer"

"Customer," "Client," "You," or "Your" refers to any individual, business, organization, lender, title company, signing service, or other entity requesting or receiving services from Rola Notary.

"Services"

Services include, but are not limited to:

Mobile Notary Services
General Notarial Acts
Acknowledgments
Jurats
Oaths and Affirmations
Signature Witnessing
Sworn Statements
Affidavits
Certified Copies where permitted by Florida law
Remote Online Notarization (RON)
Loan Signing Services
Real Estate Closing Packages
Estate Planning Document Signings
Business Document Notarization
Vehicle and DMV Document Notarization
Family and Personal Document Notarization
Witness Services
Courier and document delivery services, when offered
Other lawful notarial services performed under Florida law

"Mobile Notary"

A commissioned Florida Notary Public who travels to the Customer's requested location to perform lawful notarial acts.

"Remote Online Notarization" or "RON"

A notarization performed using approved audio-video communication technology in accordance with Florida law.

"Loan Signing"

A document presentation and notarization service related to mortgage, refinance, HELOC, reverse mortgage, seller packages, commercial loans, construction loans, or other real estate transactions. Unless separately licensed or authorized, a Loan Signing Agent does not provide legal or financial advice.

"Website"

The term "Website" refers to www.rolanotary.com, including all webpages, booking systems, forms, digital communications, and online resources operated by Rola Notary.

"Appointment"

An Appointment refers to any scheduled Mobile Notary, Remote Online Notarization, Loan Signing, or related service requested through our website, phone, email, text message, or any other approved communication method.

2. Scope of Services

Rola Notary provides professional notarial services in accordance with applicable Florida law.

Our services are limited to the lawful performance of notarial acts and related administrative services.

Unless otherwise authorized by law, we do not:

Practice law.
Provide legal advice.
Interpret legal documents.
Recommend legal strategies.
Prepare legal documents for customers.
Determine which type of notarization is required.
Choose notarial certificate wording on behalf of customers except as permitted by Florida law.

Customers are solely responsible for obtaining legal advice from a licensed attorney when necessary.

Availability of Services

Our services are subject to:

Notary availability
Scheduling availability
Geographic service areas
Technology availability
Compliance with Florida law
Successful identity verification
Safety considerations
Weather and emergency conditions

Submitting a booking request does not guarantee acceptance of an appointment.

Appointments are confirmed only after acceptance by Rola Notary.

Geographic Service Area

Mobile Notary services are primarily offered throughout Palm Beach County, Florida, and surrounding areas.

Appointments outside our normal service area may be accepted at our discretion and may incur additional travel fees.

Remote Online Notarization services are available only for transactions that qualify under applicable Florida law.

3. Mobile Notary Services

Mobile Notary appointments are performed at a mutually agreed-upon location selected by the customer and accepted by Rola Notary.

Possible appointment locations include:

Private residences
Businesses
Hospitals
Nursing homes
Assisted living facilities
Rehabilitation centers
Public libraries
Coffee shops
Hotels
Offices
Other safe public meeting locations

Rola Notary reserves the right to decline or terminate any appointment if the location presents safety concerns or otherwise prevents the lawful performance of notarial services.

Travel fees, tolls, parking fees, and other applicable charges may apply and will be disclosed before the appointment is confirmed whenever reasonably possible.

4. Remote Online Notarization (RON)

Remote Online Notarization services are performed using technology that complies with applicable Florida law.

Customers requesting RON services acknowledge and agree that:

Identity verification is required before notarization.
Audio and video communication technology will be used throughout the session.
The notary may require additional verification if identity cannot be reasonably established.
Technical failures may require the appointment to be rescheduled.
Certain documents or transactions may not qualify for Remote Online Notarization.
Audio-video recordings and electronic records may be retained as required by Florida law and by the approved RON platform.

Failure to successfully complete identity verification or maintain adequate audio-video communication may prevent completion of the notarization.

5. Loan Signing Services

Loan Signing appointments involve presenting lender-prepared documents for execution and completing any required notarial acts.

Rola Notary acts solely as an independent Notary Public and/or Notary Signing Agent.

Unless separately licensed or authorized, we do not:

Explain loan terms.
Interpret legal documents.
Provide financial advice.
Negotiate loan terms.
Recommend whether a customer should sign any document.

Questions regarding loan documents should be directed to the lender, title company, escrow officer, or attorney responsible for the transaction.

Completion of a Loan Signing appointment does not guarantee funding, recording, or approval of the transaction.

6. Appointment Requirements

To complete a notarization, Customers agree to:

Appear personally before the notary (or by approved audio-video communication for RON).
Present acceptable identification.
Ensure documents are substantially complete before the appointment.
Refrain from signing documents until instructed by the notary, unless otherwise permitted.
Ensure all required signers are present.
Ensure any required witnesses are available unless Witness Service has been purchased.
Provide accurate appointment information.
Be legally competent and willing to sign.

Appointments may be delayed, canceled, or terminated if these requirements are not met.

7. Identification Requirements

Every signer must present identification that satisfies the requirements of applicable Florida law.

Acceptable identification generally includes valid government-issued photo identification bearing a photograph, signature, and physical description or other legally acceptable identifying information.

For Remote Online Notarization appointments, customers must also successfully complete any identity proofing, credential analysis, or other verification procedures required by Florida law or the approved RON platform.

Failure to establish identity to the notary's reasonable satisfaction will result in refusal of the requested notarial act.

8. Customer Responsibilities

By scheduling an appointment, you represent and warrant that:

You are at least 18 years of age or otherwise legally authorized to enter into this agreement.
The information you provide is accurate and complete.
You have the legal authority to present the documents for notarization.
You understand the documents you are signing.
You are signing voluntarily and without coercion.
You will comply with all appointment requirements.
You understand that the notary's role is limited to performing lawful notarial acts and does not include providing legal advice or preparing documents.

Providing false, misleading, or fraudulent information may result in refusal of service and may be reported to the appropriate authorities where required by law.

9. Fees and Payment

All fees for services provided by Rola Notary are listed on our website or otherwise quoted before an appointment is confirmed. By scheduling an appointment, you agree to pay all applicable fees associated with the services requested.

Service fees may include, but are not limited to:

Notarial act fees permitted under Florida law.
Remote Online Notarization (RON) fees.
Loan Signing fees.
Mobile travel fees.
Additional signature fees.
Additional signer fees.
Witness service fees.
After-hours, weekend, holiday, emergency, or same-day appointment fees.
Printing, scanback, courier, parking, toll, or other applicable service charges.

Unless otherwise stated, all prices are quoted in U.S. Dollars (USD).

Prices are subject to change without prior notice; however, the price confirmed at the time of booking will apply to your appointment unless the scope of work changes.

Changes to Services

If additional documents, signers, signatures, witnesses, travel, or other services are requested during or after booking, additional charges may apply.

Rola Notary reserves the right to modify the total amount due when the services requested differ from those originally booked.

Payment Methods

Payment may be accepted through approved payment methods available on our website or otherwise approved by Rola Notary.

Payment may be required before, during, or immediately following completion of the appointment depending on the type of service requested.

Failure to provide payment may result in cancellation or refusal of future services.

10. Travel Fees

Mobile Notary appointments include travel to the agreed-upon meeting location.

Travel fees are separate from statutory notary fees and compensate for travel time, mileage, scheduling, and related business expenses.

Travel fees are determined based on factors including:

Distance traveled.
Appointment location.
Time of day.
Weekend or holiday scheduling.
Traffic conditions.
Special travel requirements.

Parking fees, tolls, gated community access fees, or similar expenses may be added when applicable.

Travel fees are generally non-refundable once travel has begun.

Remote Online Notarization appointments do not include travel fees.

11. Additional Signatures and Additional Signers

Unless otherwise stated, service pricing includes only the number of signatures and signers specified during booking.

Additional Notarized Signatures

If additional notarized signatures are required beyond those included in the selected service, additional fees will apply according to our current pricing schedule.

Each notarized signature constitutes a separate notarial act under Florida law.

Additional Signers

Each additional individual requiring notarization during the appointment is considered an additional signer.

Additional signer fees compensate for the additional time required for:

Identity verification.
Document review for notarial purposes.
Completion of separate notarial acts.
Recordkeeping.
Appointment administration.

Customers are responsible for accurately indicating the number of signers during booking.

12. Witness Services

Certain documents require one or more witnesses in addition to notarization.

Customers are responsible for determining whether witnesses are required for their documents.

Customers may:

Provide their own qualified witnesses, or
Purchase Witness Services from Rola Notary, when available.

Witness availability is not guaranteed unless confirmed in advance.

Additional witness fees apply according to our current pricing schedule.

Rola Notary reserves the right to decline to provide witnesses when prohibited by law or when suitable witnesses are unavailable.

13. Appointment Changes and Rescheduling

Customers may request to reschedule an appointment subject to availability.

Rescheduling requests should be made as early as possible.

Appointments rescheduled outside the timeframes described in our Cancellation & Refund Policy may be subject to additional fees.

Repeated requests to reschedule may be treated as cancellations at the discretion of Rola Notary.

14. Cancellations, Refunds, and No-Shows

Our Cancellation and Refund Policy is incorporated into these Terms by reference.

By scheduling an appointment, you acknowledge that you have reviewed and agree to our Cancellation & Refund Policy.

Without limiting that policy:

Mobile Notary appointments must generally be canceled at least three (3) hours before the scheduled appointment time to avoid applicable cancellation charges.
Remote Online Notarization appointments must generally be canceled at least two (2) hours before the scheduled appointment time.
Rescheduling requests should generally be submitted at least four (4) hours before the appointment.

Failure to appear for an appointment or failure to satisfy appointment requirements may be considered a no-show.

Travel fees, witness fees, emergency fees, after-hours fees, platform fees, and other non-recoverable costs may remain non-refundable even if the notarization is not completed.

15. Refusal of Service

Florida law requires a Notary Public to refuse a notarization under certain circumstances.

Rola Notary reserves the absolute right to refuse, discontinue, or terminate any appointment when permitted or required by law.

Service may be refused for reasons including, but not limited to:

Identity cannot be reasonably verified.
Identification presented is unacceptable under applicable law.
A signer is not personally present as required.
A signer appears unwilling or under duress.
A signer appears impaired by drugs, alcohol, medication, or any condition affecting awareness or judgment.
A signer appears unable to understand the nature of the transaction.
The document is incomplete or contains blank spaces that make notarization inappropriate.
Fraud, forgery, deception, or unlawful activity is suspected.
The requested notarial act is prohibited by law.
Required witnesses are unavailable.
Safe working conditions do not exist.
The appointment location presents a safety concern.
Required technology for Remote Online Notarization is unavailable or fails.
Any other circumstance requiring or permitting refusal under applicable law.

Refusal of a notarization does not constitute a breach of these Terms and does not create liability on the part of Rola Notary.

16. Documents We Cannot Notarize

Rola Notary performs only lawful notarial acts authorized under Florida law.

We may decline to notarize documents including, but not limited to:

Blank or substantially incomplete documents.
Documents lacking required notarial wording when the customer cannot identify the appropriate notarial act.
Documents involving suspected fraud or forgery.
Documents prohibited by law.
Documents requiring unauthorized legal advice.
Documents presented without all required signers.
Documents for which identity cannot be established.

Acceptance of a document for review does not guarantee that it can or will be notarized.

17. No Legal Advice

Rola Notary is not a law firm.

Unless separately licensed to practice law, our notaries, signing agents, employees, and representatives do not:

Provide legal advice.
Draft legal documents.
Select legal forms.
Interpret contracts.
Explain legal rights.
Recommend legal strategies.
Determine which notarial certificate should be used on behalf of customers, except as permitted by law.

Customers seeking legal guidance should consult a licensed attorney.

Nothing contained on our website, in our communications, or during an appointment should be interpreted as legal advice.

18. Privacy and Confidentiality

Rola Notary respects the confidentiality of customer information and documents.

Documents provided for notarization are handled solely for the purpose of performing the requested services.

Customer information is collected, stored, and used in accordance with our Privacy Policy.

Where required by Florida law, notarial journals, electronic records, audio-video recordings, and related documentation may be retained for the legally required retention period.

We may disclose information only:

As required by law.
In response to lawful court orders or government requests.
To complete requested services through authorized service providers.
To protect our legal rights.
To investigate suspected fraud or unlawful activity.

Customers acknowledge that certain records associated with Remote Online Notarization cannot be altered or deleted before the expiration of the applicable legal retention period.

19. Electronic Communications

By using our website, submitting an inquiry, requesting a quote, scheduling an appointment, or providing your contact information, you consent to receive communications from Rola Notary electronically.

These communications may include, but are not limited to:

Appointment confirmations
Appointment reminders
Booking updates
Payment confirmations
Receipts and invoices
Service-related notices
Responses to inquiries
Changes to appointments
Policy updates
Other administrative communications necessary to provide our services

Electronic communications may be delivered by email, text message (SMS), telephone, or other communication methods you have authorized.

You are responsible for providing accurate and current contact information. Rola Notary is not responsible for missed appointments or delays resulting from inaccurate, outdated, or incorrect contact information provided by you.

20. Electronic Signatures and Consent

Where permitted by applicable law, you agree that electronic signatures, electronic records, electronic acknowledgments, electronic approvals, and electronic agreements have the same legal effect as handwritten signatures.

By scheduling services online, checking required acknowledgment boxes, submitting electronic forms, or completing electronic payment, you consent to conduct business electronically.

This consent applies to:

Appointment scheduling
Payment authorization
Service agreements
Policy acknowledgments
Electronic communications
Other transactions conducted through our website or approved service providers

21. Remote Online Notarization Recording Consent

Remote Online Notarization ("RON") appointments are conducted using secure audio-video communication technology approved under applicable Florida law.

By requesting a Remote Online Notarization appointment, you acknowledge and agree that:

The session may be audio and video recorded.
Identity verification information may be collected.
Credential analysis and identity proofing may be performed.
Electronic journal entries may be created.
Electronic records may be retained for the period required by applicable law.

These recordings and records are maintained to comply with Florida law and applicable regulations governing Remote Online Notarization.

Customers acknowledge that Rola Notary does not control the internal policies, security practices, or retention requirements of approved third-party Remote Online Notarization platforms.

22. Website Use

The content available on www.rolanotary.com is provided for general informational purposes only.

By using our website, you agree to use it only for lawful purposes.

You agree not to:

Attempt to gain unauthorized access to our systems.
Upload malicious software, viruses, or harmful code.
Interfere with website functionality.

That Remote Online Notarization technology will always function without interruption.

The notarial act performed by Rola Notary confirms only those facts authorized under Florida law and should not be interpreted as an endorsement, approval, validation, or guarantee of the underlying document or transaction.

26. Limitation of Liability

To the fullest extent permitted by applicable law, Rola Notary, its owners, officers, employees, commissioned notaries, contractors, agents, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to:

Use of our website.
Scheduling appointments.
Mobile Notary services.
Remote Online Notarization services.
Loan Signing services.
Delays caused by customers or third parties.
Technology failures beyond our reasonable control.
Government actions.

You agree to defend, indemnify, and hold harmless Rola Notary, Rola LLC, its owners, commissioned notaries, employees, contractors, agents, and representatives from any claims, damages, liabilities, costs, expenses, or attorney's fees arising out of or related to:

28. Force Majeure

In such circumstances, appointments may be postponed, rescheduled, modified, or canceled without liability.

Rola Notary will make reasonable efforts to notify affected customers and reschedule appointments as soon as practicable.

29. Professional Standards

Rola Notary is committed to conducting all services professionally, ethically, and in accordance with applicable Florida law.

Nothing in these Terms shall require a commissioned Florida Notary Public to perform any act that would violate Florida law, administrative rules, ethical obligations, or the notary's official duties.

Whenever a conflict exists between these Terms and applicable law, the applicable law shall control.

30. Governing Law

These Terms of Service and any dispute arising from or relating to your use of our website or services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

All notarial acts performed by Rola Notary are subject to applicable Florida statutes, administrative rules, and other governing laws regulating Florida Notaries Public and Remote Online Notaries.

Nothing contained in these Terms shall be interpreted to require a Florida Notary Public to perform any act prohibited by applicable law.

31. Dispute Resolution

Rola Notary values resolving concerns fairly, promptly, and professionally.

If you have a concern regarding our services, you agree to contact us first and provide a reasonable opportunity to resolve the matter before initiating legal proceedings.

If a dispute cannot be resolved informally, it shall be brought in a court of competent jurisdiction located in Palm Beach County, Florida, unless another venue is required by applicable law.

Nothing in this section limits Rola Notary's right to seek injunctive relief or other legal remedies available under applicable law.

32. Compliance With Florida Law

Rola Notary performs all notarial services in accordance with applicable Florida law.

If any provision of these Terms conflicts with a mandatory provision of Florida law, the applicable law shall control, and the remaining provisions shall remain in full force and effect.

Any modification to Florida notary laws, Remote Online Notarization regulations, or other applicable legal requirements shall automatically govern the services provided by Rola Notary to the extent required by law.

33. Accuracy of Information

Customers are solely responsible for the accuracy, completeness, and legality of all information, documents, and instructions provided to Rola Notary.

Rola Notary is not responsible for:

Misspelled names.
Incorrect addresses.
Incorrect legal descriptions.
Missing pages.
Incorrect document preparation.
Errors contained within customer-provided documents.
Incorrect instructions provided by customers or third parties.

Customers are encouraged to carefully review all documents before requesting notarization.

34. Record Retention

Rola Notary maintains records as required by applicable Florida law.

Certain records, including electronic journals, Remote Online Notarization recordings, identity verification records, and other legally required documentation, may be retained for the period required by law.

Once a legally required retention period expires, records may be securely destroyed in accordance with applicable law and our record retention practices.

35. Assignment

Customers may not assign or transfer their rights or obligations under these Terms without the prior written consent of Rola Notary.

Rola Notary may assign or transfer its rights or obligations to a successor business entity, affiliate, purchaser, or other lawful assignee without prior notice, provided such assignment does not reduce the customer's legal rights under applicable law.

36. Severability

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified or severed only to the extent necessary to comply with applicable law.

The remaining provisions shall remain valid, enforceable, and in full force and effect.

37. Waiver

Failure by Rola Notary to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other provision.

Any waiver shall be effective only if made in writing and signed by an authorized representative of Rola Notary.
